1. Agreement and acceptance
These Terms of Service are a binding agreement between you and Youth Sports Clarity ("YSC," "we," "us," or "our"). If you do not agree, do not use the Services. If you use the Services for an organization or another person, you represent that you have authority to bind them.
2. What we provide
YSC provides educational content, parent advocacy and organization tools, documentation resources, communication templates, courses, digital products, private record tools, and AI-assisted drafting features related to youth sports communication and decision-making.
YSC is not a law firm, medical or mental-health provider, emergency or crisis service, investigative body, child-protection agency, mandated-reporting service, SafeSport reporting channel, school, club, league, governing body, or government agency.
3. Eligibility and adult use
You must be at least 18 and legally capable of entering a contract to create an account, purchase, subscribe, upload content, or use an interactive tool. A parent or guardian may share appropriate educational content with a minor under direct supervision, but minors may not independently create accounts, purchase, upload files, or submit personal information.
4. Accounts and security
Provide accurate information, protect your credentials, and promptly notify support@youthsportsclarity.com of suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our failure to use reasonable security measures. We may use email confirmation, password resets, and other safeguards.
5. License and permitted use
Subject to these Terms and applicable fees, YSC grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Services and purchased materials for non-commercial family use. You may edit and share a completed communication or report with relevant recipients for your matter, but may not distribute blank templates, course materials, libraries, or substantial portions of the Services.
6. Prohibited conduct
You may not:
- use the Services for unlawful, fraudulent, threatening, harassing, discriminatory, exploitative, or deceptive activity;
- submit knowingly false accusations, fabricate evidence, impersonate another person, or use outputs to defame, intimidate, retaliate, or target;
- upload sexual content involving a minor, malware, unlawfully obtained material, or content you have no right to provide;
- use the Services as a substitute for emergency, mandated, or official reporting or professional advice;
- scrape, copy, resell, redistribute, reverse engineer, bypass security, access another account, or test vulnerabilities without authorization;
- share accounts or use YSC content or private output to train or build an AI system without written permission; or
- remove ownership notices or falsely imply endorsement, accreditation, affiliation, or official status.
7. User Content
"User Content" includes information or material you submit, upload, save, type, record, or generate through the Services. You retain ownership. You grant YSC and its service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, format, and process User Content only as reasonably necessary to provide, secure, maintain, troubleshoot, improve, and support the Services, follow your instructions, enforce these Terms, or comply with law.
You represent that you have the rights and lawful authority needed to submit the content. You are responsible for its accuracy, legality, relevance, and disclosure. Use initials or roles where practical and avoid unnecessary information about children or third parties.
8. Safety and sensitive situations
YSC does not continuously monitor submissions and does not promise to detect, review, report, escalate, or respond to dangerous or unlawful content. Entering information does not notify an outside person or authority.
For immediate danger call 911 or the appropriate local emergency service. For suspected child abuse, sexual misconduct, grooming, serious threats, self-harm, violence, or urgent safety concerns, contact the appropriate law-enforcement, child-protection, medical, school, league, governing-body, or SafeSport channel directly.
9. AI-assisted and automated features
AI, templates, and rules-based automation may produce inaccurate, incomplete, outdated, biased, overly strong, overly soft, legally inappropriate, emotionally inappropriate, or unsuitable output. Independently review, edit, verify, and approve every output. Do not rely on it as evidence, a finding, professional judgment, legal conclusion, safety assessment, or predicted outcome.
10. Intellectual property
The Services and YSC-provided software, interfaces, workflows, designs, text, graphics, logos, names, audio, video, courses, templates, downloads, compilations, and materials belong to YSC or its licensors and are protected by law. Youth Sports Clarity, Parent Clarity, and associated branding may not be used without written permission.
11. Third-party services and app stores
The Services may rely on third-party hosting, authentication, storage, payment, analytics, email, support, and AI providers. Their services are governed by their own terms and policies. App-store terms also apply to marketplace downloads and purchases; marketplace purchases, cancellations, and refunds may need to be managed through that marketplace.
12. Purchases, billing, and taxes
Prices and included features are disclosed at checkout and may change prospectively. You authorize YSC and its payment processors to charge the payment method provided for disclosed prices, recurring fees, taxes, and agreed charges. Payment processors ordinarily receive complete payment-card details; YSC receives transaction and status information.
13. Subscription renewal and cancellation
A subscription automatically renews for the disclosed renewal period and price unless canceled before the renewal date. You may cancel through the identified account or billing portal or by contacting support@youthsportsclarity.com. Cancellation stops future renewal charges but ordinarily does not end access before the close of the paid billing period. Deleting an app does not cancel a subscription. App-store subscriptions generally must be canceled through the store.
14. Refund policy
Except where required by law or expressly stated at checkout, digital downloads, templates, courses, and immediately accessible digital content are final after access or download. Subscription fees and prior renewals are non-refundable after the billing period begins, with no prorated refunds for unused time, inactivity, or failure to cancel.
For a materially defective or inaccessible product, verified technical issue, or mistaken purchase, contact support within seven days. We may repair access, replace the product, issue credit, or refund at our discretion. Non-waivable consumer rights remain unaffected. Marketplace purchases follow the marketplace process.
15. Availability and beta features
We may add, change, restrict, suspend, or discontinue features, integrations, storage limits, or Services. We do not guarantee uninterrupted, error-free, secure, compatible, or permanent availability. Preview, beta, experimental, and free features may change without notice. Back up important records; the Services are not an archival or evidence-preservation system.
16. Suspension and termination
We may investigate suspected misuse and remove content or suspend, limit, or terminate access to enforce these Terms, prevent harm, address security or legal risk, respond to nonpayment, or protect YSC, users, minors, or third parties. Account deletion does not necessarily cancel separately billed subscriptions.
17. Copyright and rights complaints
Send a detailed complaint to support@youthsportsclarity.com identifying the protected work or right, the disputed material and location, your contact information, good-faith and accuracy statements, proof of authority, and a signature. We may remove material and terminate repeat infringers where appropriate.
18. No professional relationship
Use does not create an attorney-client, doctor-patient, therapist-client, counselor-client, fiduciary, advocate-client, investigator, confidential-source, or other professional relationship. Communications are not privileged, and support personnel do not represent you.
19. Warranty disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, CONTENT, OUTPUTS, PRODUCTS, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. YSC AND ITS OWNERS, AFFILIATES, LICENSORS, VENDORS, AND SERVICE PROVIDERS DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, QUIET ENJOYMENT, SECURITY, AVAILABILITY, AND RESULTS.
20. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YSC AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, LICENSORS, VENDORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, PLAYING TIME, TEAM PLACEMENT, OR REPUTATION; EMOTIONAL DISTRESS; PERSONAL OR FAMILY CONFLICT; OR SUBSTITUTE-SERVICE COSTS.
TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO YSC FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT FIRST GIVING RISE TO LIABILITY. LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED IS NOT EXCLUDED.
21. Indemnification
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless YSC and its owners, affiliates, employees, contractors, licensors, vendors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your User Content, unlawful or unauthorized use, breach, violation of another person’s rights, or messages, reports, allegations, or materials you send or publish using the Services.
22. Informal dispute process
Before filing a lawsuit other than urgent injunctive relief or a qualifying small-claims matter, send written notice describing the dispute, facts, requested relief, and contact information to support@youthsportsclarity.com and the mailing address below. The parties will attempt in good faith to resolve the matter for 30 days.
23. Governing law and venue
California law governs without regard to conflict-of-laws principles. Subject to non-waivable consumer rights, court proceedings must be brought exclusively in state or federal courts in Orange County, California, and each party consents to personal jurisdiction. Either party may bring an eligible individual small-claims matter.
24. Changes to these Terms
We may update these Terms prospectively and will update the "Last updated" date. For material changes, we will provide additional notice where required. Continued use after the effective date constitutes acceptance to the extent permitted by law.
25. General terms and contact
These Terms, the Privacy Policy, General Disclaimer, and specific checkout or product terms are the entire agreement about the Services. Unenforceable provisions will be modified to the minimum extent necessary or severed. Failure to enforce is not a waiver.
